Account Terms – Atelier Verden
These account terms (hereinafter: the "Account Terms") apply to the use of a customer account on www.atelierverden.com (hereinafter: the "Website") by customers (hereinafter: the "Customer").
By explicitly agreeing to these Account Terms when creating an account on the Website, the Customer declares to comply with these terms.
1. Account Requirement
To place orders on the Website, a customer account is required. The customer account can be created prior to or during the ordering process. These Account Terms apply to both consumer and business Customers of Atelier Verden.
2. Minimum Age Requirement
The Customer declares to be at least 18 years old when creating an account. It is not permitted for individuals under the age of 18 to create or use a customer account.
3. Business Accounts
Business Customers have the option to create multiple individual user accounts within the account environment. Any reference to a customer account in these Account Terms shall, for business Customers, also refer to individual user accounts, unless explicitly stated otherwise.
4. Confidentiality Obligation
The Customer is required to keep the login details of the customer account strictly confidential and to use them with due care.
5. Personal Use and Liability
The customer account is intended for personal use by the Customer only. Granting third-party access to the customer account is not permitted. The Customer is fully responsible and liable for all actions performed through the customer account. In case of suspected unauthorized use, the Customer must immediately change the password and notify Atelier Verden as soon as possible.
6. Prohibited Use and Fraud
Use of the customer account for unlawful or fraudulent purposes is strictly prohibited. This includes, but is not limited to:
violation of applicable laws or Atelier Verden’s general terms and conditions;
abuse of return policies;
fraudulent refund requests;
unauthorized reselling;
use of malicious software or technology;
systematic circumvention of purchase restrictions or disruptive use of the platform.
7. Enforcement Powers
In the event of (suspected) violation of article 6, Atelier Verden is entitled to take appropriate measures, including but not limited to:
refusing or canceling orders;
restricting payment options;
limiting the number of products per order or per Customer;
blocking the customer account.
Atelier Verden is not liable for any damage suffered by the Customer or third parties as a result of these measures.
8. Account Closure or Refusal
Atelier Verden reserves the right to immediately close or refuse a customer account if the Customer acts in violation of these Account Terms or other applicable conditions, or if there are reasonable grounds for such suspicion.
9. Prohibition on New Accounts after Closure
It is not permitted to create a new customer account if a previous account has been closed or refused by Atelier Verden under articles 6 or 8.
10. Termination by the Customer
The Customer may terminate the customer account at any time via the account settings on the Website. Closure of the customer account does not affect any outstanding obligations or claims. Personal data will be deleted in accordance with applicable privacy legislation, unless a legal retention obligation exists.
11. Relation to General Terms and Conditions
These Account Terms apply in addition to Atelier Verden’s General Terms and Conditions of Sale. In case of any conflict, the provisions of the General Terms and Conditions shall prevail.
12. Restriction to Use Within the EU
Atelier Verden only accepts customer accounts from individuals or businesses with a delivery address within the European Union. Creating an account for delivery outside the EU is not permitted.
13. Reference to Privacy Policy
The processing of personal data in relation to the customer account is governed by Atelier Verden’s Privacy Policy. By creating an account, the Customer agrees to this policy.
14. No Waiver of Rights
If Atelier Verden does not immediately exercise any of its rights under these Account Terms, this does not constitute a waiver of those rights.
15. Changes
Atelier Verden reserves the right to amend these Account Terms. Amended terms will be published on the Website and made available to the Customer upon login. Continued use of the customer account after amendments constitutes acceptance of the revised terms. If the Customer does not accept the amended terms, they must terminate their account.
16. Applicable Law
These Account Terms are governed by Dutch law.
